Terms of Service

These terms govern your use of ShadowViral™ AI. By creating an account or using the service you agree to them. If you do not agree, do not use the service.

Operator. ShadowViral™ AI is operated by a registered sole trader (obrt) established in the Republic of Croatia, European Union. The service is provided under Croatian and EU law, including the Electronic Commerce Act and the Consumer Protection Act.

1. What the service does

ShadowViral™ AI compiles rankings of faceless short-form videos by category, produces AI-generated analyses of why a given video performed, generates original scripts modelled on those patterns, and surfaces affiliate-program research. YouTube metrics come from the live YouTube Data API; Instagram Reel metrics and TikTok post, hashtag and sound data are measured through third-party scraping actors, cached, and ranked in our database from those raw platform counts. Any figure we cannot measure is badged as an AI estimate. Verify anything you intend to rely on.

2. Accounts and eligibility

  • You must be at least 16 and able to enter a binding contract.
  • Registration requires accurate name, address and contact details. Providing false details, or creating multiple accounts to obtain additional trials or discounts, is a breach of these terms and may result in termination without refund.
  • You are responsible for activity under your account and for keeping it secure.
  • Accounts are personal. Do not share credentials or resell access.

3. Access tiers

  • Guests may browse categories and public pages.
  • Registered free users may browse but not run deep analyses or generate scripts.
  • Trial and paid subscribers get full access to analysis and script generation, subject to fair use.

4. Free trial

  • The 7-day trial requires valid card details up front.
  • Unless you cancel before the trial ends, it converts automatically to a paid subscription at the then-current price.
  • Each person is entitled to one trial. Once used, the flag is permanent; returning users are offered a discounted direct subscription instead.

5. Subscriptions, pricing and renewal

  • Plans are billed monthly or yearly in advance and renew automatically until cancelled.
  • Promotional pricing, including limited-time discounts, applies only while the offer is live and on the terms shown at checkout.
  • We may change prices with at least 30 days’ notice before the change takes effect on your next renewal.
  • Payment is handled by our payment processor. If a charge fails, access continues during the processor’s automatic retry window; if all retries fail, access is suspended.
  • Taxes are added where required. You are responsible for any taxes not collected at checkout.

6. Cancellation and refunds

  • Cancel at any time from the billing page. Access continues to the end of the paid period; we do not pro-rate partial periods.
  • We may ask for optional cancellation feedback. You may skip it and the cancellation still proceeds.
  • Outside statutory rights, fees already paid are non-refundable. As we are established in Croatia, EU consumers have a 14-day right of withdrawal under the Consumer Protection Act (Zakon o zaštiti potrošača) implementing Directive 2011/83/EU. By starting an analysis or script generation during that period you expressly request immediate performance and acknowledge you lose the withdrawal right once the digital service has been fully supplied.
  • We may suspend or terminate an account for breach of these terms, fraud, chargeback abuse, or legal requirement.

7. Acceptable use

You must not:

  • Scrape, resell, or systematically export the rankings, analyses or affiliate data.
  • Reverse engineer the service or circumvent access tiers, rate limits or paywalls.
  • Use the service to create content that infringes copyright, impersonates a creator, or violates TikTok, YouTube or any other platform’s rules.
  • Generate unlawful, defamatory, harassing, or deceptive content.
  • Attempt to disrupt the service or gain unauthorised access to it or other accounts.

8. Your content and generated output

  • You keep ownership of the prompts and inputs you supply. You grant us a licence to process them solely to operate the service.
  • Subject to your account being in good standing, you may use scripts generated for you commercially, including in monetised videos.
  • AI output is not guaranteed to be unique. Similar prompts can produce similar output for different users, and you are responsible for reviewing output before publishing.
  • The rankings, source video references and platform data remain ours or their respective owners’.

11. Third-party platform policies and account risk

Social media platforms (including TikTok, YouTube, Instagram, and Facebook) operate proprietary, evolving moderation algorithms and community guidelines.

ShadowViral does not guarantee that content, scripts, or formats generated through the platform will remain eligible for monetization, avoid shadowbans, or be protected from “unoriginal content” or “re-used content” strikes.

You assume full responsibility for confirming that all assets (including B-roll footage, sound recordings, visual effects, and voiceovers) are fully licensed for commercial use before distribution.

12. Financial metrics, RPMs and earnings projections

Any revenue-per-mille (RPM) figures, monetization estimates, affiliate commission tiers, or earnings projections displayed across niches are aggregated historical estimates and hypothetical benchmarks.

Actual revenue depends on multiple external variables outside of ShadowViral’s control, including viewer geography, audience retention, ad inventory seasonality, platform payout changes, and individual conversion rates. ShadowViral makes no express or implied warranty of income or commercial success.

13. Affiliate marketing and regulatory compliance

When utilizing automated affiliate insertion or script monetization features, you are solely responsible for complying with all applicable advertising laws, trade commission regulations (such as FTC guidelines in the United States and equivalent international standards), and platform-specific branded content policies.

You must ensure that proper, clear, and conspicuous disclosures (e.g., #ad, #sponsored, or explicit spoken disclaimers) are included in all published material.

14. Data provenance and AI-generated content

Trend analytics, hashtag velocity, and leaderboard rankings are compiled via public data extraction, periodic snapshots, and predictive estimation.

Metrics tagged as “Recent snapshot” or “AI estimate” reflect cached or modeled conditions and may not reflect real-time platform states. ShadowViral assumes no liability for editorial decisions made based on cached, modeled, or degraded data feeds.

15. Third-party services and affiliate links

The service depends on third-party providers for hosting, payments, AI models and email. Affiliate program listings are research and may include links from which we could earn a commission. We do not endorse, control, or guarantee the terms, payout rates or availability of any third-party program.

16. Disclaimers

The service is provided “as is” and “as available”. We do not warrant that rankings are accurate or complete, that generated content will perform, or that the service will be uninterrupted or error free. Nothing here promises any level of views, revenue, monetisation approval, or business outcome.

17. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, lost profits, lost revenue, lost data, or platform strikes, demonetisation or account removal arising from content you publish. Our total aggregate liability is limited to the amount you paid us in the 12 months before the claim. Nothing limits liability that cannot be limited by law, including for fraud or death or personal injury caused by negligence.

18. Indemnity

You will indemnify us against claims arising from content you publish using the service or from your breach of these terms or of a third-party platform’s rules.

19. Changes to the service or these terms

We may modify features or these terms. Material changes are announced by email or in the app at least 30 days before they take effect for existing subscribers. Continuing to use the service after that date means you accept the change.

20. General

If any provision is unenforceable, the rest remains in force. Failure to enforce a term is not a waiver. You may not assign these terms without our consent; we may assign them to a successor entity. These terms, together with the Privacy Policy, form the entire agreement between us. These terms are governed by the laws of the Republic of Croatia, excluding its conflict-of-law rules, and the competent courts of Croatia have jurisdiction. Nothing here removes the mandatory consumer protection of the EU member state where you habitually reside, and EU consumers may also use the European Commission’s online dispute resolution platform at ec.europa.eu/consumers/odr.
